By accessing our website, placing an order, or using our services, you agree to be bound by these Terms and Conditions, along with our Legal Disclaimer, Privacy Policy, and other policies referenced herein. If you do not agree with any part of these terms, please do not use our services.
1. Services Offered
Crafted Memories Photo Albums LLC provides the following services:
- Custom photo album design and layout
- Photo restoration and enhancement
- Professional album printing and binding
- Photo book creation with various paper and binding options
- Photo selection and curation services for registered photographers
- Complementary packaging including boxes, bags, and cover pages where applicable
All services are custom-made to order based on customer specifications and requirements. Service availability, options, and pricing are subject to change without prior notice.
2. How to Order
2.1 Order Placement
Customers may place orders by:

2.2 Order Confirmation
Once we receive your inquiry, we will:
- Discuss your project requirements and vision

- Send a formal order confirmation and invoice for the initial deposit
- Begin work only after receiving the required deposit payment
2.3 Order Acceptance
All orders are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to:
- Concerns about copyright or image rights
- Inappropriate or offensive content
- Suspected fraudulent activity
- Inability to meet customer requirements
- Unavailability of materials or services
3. Pricing and Fees
3.1 Pricing Structure
Our pricing is based on:
- Album type (photo book, wedding album, custom album, etc.)
- Paper type and quality
- Binding type
- Number of pages or spreads
- Additional services (photo restoration, selection, enhancement)
- Complementary items (boxes, bags, cover pages)
Prices are quoted on a per-album basis and will be clearly communicated before you commit to an order.
3.2 Price Changes
We reserve the right to adjust pricing due to:
- Changes in printing costs or material costs
- Customer-requested modifications after initial quote
- Additional services requested during the project
- Supplier price increases
Any price changes will be communicated to you before proceeding with work.
3.3 Additional Fees
The following may result in additional charges:
- Major revisions beyond the agreed scope
- Expedited services (if available)
- Special materials or printing techniques
- Additional copies of the same album
- Shipping and handling (billed separately)
4. Payment Terms
4.1 Deposit Requirement
A $200 non-refundable deposit is required before we begin work on any project. This deposit confirms your order and reserves our time and resources for your project.
4.2 Payment Schedule
- Initial Deposit: $200 due upon order confirmation
- Balance Payment: Full remaining balance due before printing begins
- Shipping Costs: Billed separately via invoice after album completion
4.3 Accepted Payment Methods
We accept the following payment methods:
- Credit cards (Visa, MasterCard, American Express, Discover)
- Debit cards
- PayPal
All payments are processed securely through Stripe. We may accept additional payment methods in the future, which will be communicated on our website.
4.4 Payment Failure
If payment fails or is declined:
- We will notify you immediately
- Work on your project will be paused until payment is received
- If payment is not received within 14 days of notification, we reserve the right to cancel your order
- The $200 deposit remains non-refundable
4.5 Late Payments
The balance payment must be made within 7 days of proof approval. Projects with unpaid balances for more than 30 days may be cancelled, with the deposit forfeited.
5. Customer Responsibilities
5.1 Image Submission
You are responsible for:
- Providing high-quality digital images in the requested format
- Ensuring all images are properly backed up before submission
- Verifying that all images are free from corruption or technical issues
- Submitting images within agreed timelines to avoid project delays
5.2 Copyright and Image Rights
By submitting images, you warrant that:
- You own the copyright to all images, OR
- You have obtained all necessary permissions, licenses, and releases to use the images
- The images do not violate any third-party rights (copyright, trademark, privacy, publicity)
- You have the right to reproduce and publish these images in an album
You agree to indemnify and hold harmless Crafted Memories Photo Albums LLC from any claims arising from your submission of unauthorized or restricted content.
5.3 Content Review
You must:
- Review all design proofs carefully and thoroughly
- Provide feedback and approval in a timely manner
- Notify us of any errors, concerns, or desired changes before final approval
- Understand that approval of proofs releases us from liability for the final printed product
5.4 Communication
You agree to:
- Respond to our communications within reasonable timeframes
- Provide accurate contact information
- Inform us promptly of any changes to your project requirements
- Maintain respectful and professional communication
6. Design Process and Proofs
6.1 Design Timeline
Our typical turnaround time is 4-6 weeks from deposit payment to final delivery. This timeline includes:
- Initial design and layout
- Customer review and revisions
- Printing and binding
- Shipping
Actual timelines may vary based on project complexity, revision requests, printing partner availability, and shipping conditions.
6.2 Proof Review and Revisions
- We will provide digital proofs for your review before printing
- You will have the opportunity to request reasonable revisions within the agreed project scope
- Minor adjustments (text corrections, small layout changes) are included
- Major redesigns or significant changes may incur additional fees
- You must approve proofs within 14 days of receiving them, or we may pause your project
6.3 Final Approval
Once you provide written approval (email confirmation) of the final proof:
- We will proceed to printing
- No further changes can be made
- You accept full responsibility for the content, layout, and design
- The album will be produced exactly as shown in the approved proof
IMPORTANT: Once you approve the proof, we cannot accept responsibility for errors you failed to catch during the review process.
7. Cancellations and Refunds
7.1 Cancellation by Customer
You may cancel your order before printing begins with the following conditions:

$50 minimum non-refundable fee applies to all cancellations to cover administrative costs

Additional fees may apply based on the amount of work completed at the time of cancellation

Refund amounts are calculated as follows:
- Before design work begins: Deposit minus $50 cancellation fee
- After design begins but before first proof: Deposit minus $50-$100 (depending on work completed)
- After first proof delivered: Deposit minus $100-$150 (depending on revisions completed)
- After final proof approval: No refund available (order cannot be cancelled)

7.2 Cancellation by Company
We reserve the right to cancel your order at any time for reasons including:
- Inability to fulfill the order due to technical or supplier issues
- Concerns about content legality or appropriateness
- Non-payment or payment issues
- Lack of communication or cooperation from the customer
- Force majeure events (see Section 13)
If we cancel your order:
- You will receive a full refund of all payments made
- We are not liable for any consequential damages or losses
- Any completed design work may be provided to you at our discretion
7.3 Non-Refundable Custom Work
Due to the custom, personalized nature of our services:
- Albums are generally non-refundable once printing begins
- Completed albums are non-refundable except for manufacturing defects covered under warranty
- Custom design work, once approved, is considered a completed service and is non-refundable
8. Modifications to Orders
8.1 Before Proof Approval
You may request changes to your order before final proof approval:
- Minor changes (text, small layout adjustments) are generally included
- Major changes (complete redesign, different album type) may incur additional fees and extend timelines
- All modification requests must be submitted in writing (email)
8.2 After Proof Approval
Once you approve the final proof:
- No changes can be made to the album design or content
- The album will be printed exactly as approved
- Any requests for changes will require a new order at full cost
8.3 Modification Fees
If requested changes significantly increase our workload:
- We will provide a quote for additional fees before proceeding
- You may choose to accept the fees or proceed with the original design
- Timeline extensions may apply
9. Turnaround Times and Delays
9.1 Estimated Timelines
Our standard turnaround time is 4-6 weeks, which includes:
- 1-2 weeks: Initial design and first proof delivery
- 1-2 weeks: Revisions and final proof approval (customer-dependent)
- 2-3 weeks: Printing, binding, quality control, and shipping
These are estimates and may vary based on:
- Project complexity and size
- Number of revision rounds
- Customer responsiveness
- Printing partner availability
- Shipping carrier performance
- Holiday periods and peak seasons
9.2 Rush Services
We do not currently offer expedited or rush services due to the time-intensive, high-quality nature of our work. We appreciate your understanding and patience as we create your album with care and attention to detail.
9.3 Delays Beyond Our Control
We are not responsible for delays caused by:
- Customer delays in providing images, feedback, or approvals
- Printing partner delays or issues
- Shipping carrier delays
- Natural disasters, pandemics, or other force majeure events
- Supply chain disruptions
- Technical failures beyond our control
We will communicate any anticipated delays as soon as we become aware of them and will work diligently to minimize their impact.
10. Shipping and Delivery
10.1 Shipping Coverage
We ship nationwide within the United States. International shipping is not currently available.
10.2 Shipping Costs
Shipping and handling charges are billed separately after your album is complete. You will receive an invoice for actual shipping costs based on:
- Album size and weight
- Shipping destination
- Carrier selected
- Insurance and tracking options
10.3 Shipping Methods
We use reputable shipping carriers including USPS, FedEx, and UPS. All shipments include:
- Tracking information
- Shipping insurance (for declared value)
- Secure packaging to protect your album
10.4 Delivery Timeframes
Shipping times vary by location and carrier:
- Standard shipping: 5-7 business days
- Priority shipping: 2-3 business days (if available)
- Exact times depend on carrier performance and destination
10.5 Shipping Risk
Once your album is shipped:
- Risk of loss or damage transfers to you upon delivery
- Damage during shipping should be reported to the carrier
- We will assist with insurance claims if shipping damage occurs
- We are not responsible for delays, loss, or damage caused by the carrier beyond our control
10.6 Address Accuracy
You are responsible for:
- Providing a complete and accurate shipping address
- Being available to receive the shipment
- Additional shipping costs if re-delivery is needed due to incorrect address or unavailability
11. Warranty and Reprints
11.1 Limited Warranty
We guarantee that your album will be free from manufacturing defects at the time of shipment, including:
- Binding failures or defects
- Printing errors (misprints, color errors not due to screen/print differences)
- Material defects (torn pages, damaged covers)
This warranty is valid for 14 days from the date of delivery.
11.2 Warranty Exclusions
This warranty does not cover:
- Normal wear and tear
- Damage during shipping (claim through carrier insurance)
- Damage after delivery to you
- Misuse, mishandling, or improper storage
- Color variations between your screen and printed product (see Section 11.4)
- Issues resulting from low-quality source images
- Design or content errors you approved in proofs
11.3 Warranty Claims
To make a warranty claim:
- Contact us within 14 days of delivery
- Provide photographic evidence of the defect
- Describe the issue in detail
- Return the defective album (if requested) at our expense
If your claim is valid, we will:
- Reprint the album at no charge, OR
- Provide a replacement album, OR
- Issue a refund (at our discretion)
11.4 Color Accuracy
Please note:
- Colors on screens vary due to monitor calibration, lighting, and settings
- Printed colors may differ slightly from what you see on screen
- We use professional color management, but exact screen-to-print matching is not guaranteed
- Color variations within industry standards are not considered defects
12. Intellectual Property Rights
12.1 Our Intellectual Property
All designs, layouts, templates, and creative work produced by Crafted Memories Photo Albums LLC remain our intellectual property unless otherwise agreed in writing.
This includes:
- Album layout designs and templates
- Custom design elements we create
- Our branding and creative approach
- Any proprietary processes or techniques
12.2 License to Use
You receive a personal, non-transferable license to:
- Use the final album design for your personal purposes
- Display and share photos of your completed album
- Order reprints of the same album through us
You may not:
- Resell or redistribute our designs
- Use our templates for commercial purposes
- Claim our designs as your own work
- Modify and resell albums without permission
12.3 Portfolio and Marketing Use
We may request permission to use your completed album in our portfolio, website, and marketing materials. This will be requested through our separate Photo & Album Usage Release Form. We will not use your album for promotional purposes without your explicit written consent.
13. Limitation of Liability
13.1 Maximum Liability
Our total liability for any claim arising from our services, regardless of the form of action (contract, tort, negligence, etc.), shall not exceed the total amount you paid for the specific service in question.
13.2 Excluded Damages
We are not liable for:
- Indirect, incidental, consequential, or special damages
- Lost profits or business opportunities
- Lost data or files (you must maintain backups)
- Emotional distress or sentimental value
- Third-party claims arising from your content
- Damages caused by third-party services (printers, shippers)
13.3 Indemnification
You agree to indemnify, defend, and hold harmless Crafted Memories Photo Albums LLC, its owners, employees, and partners from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:
- Your breach of these Terms and Conditions
- Your submission of copyrighted, unauthorized, or illegal content
- Your violation of any third-party rights
- Your misuse of our services
14. Force Majeure
We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Acts of God (earthquakes, floods, fires, storms)
- Pandemics, epidemics, or public health emergencies
- War, terrorism, civil unrest, or government action
- Labor disputes or strikes
- Supply chain disruptions
- Internet, telecommunications, or power failures
- Failure of third-party suppliers, printers, or carriers
In such events, our performance obligations will be suspended for the duration of the force majeure event, and we will not be liable for any resulting delays or damages.

Before pursuing formal legal action, you agree to contact us to attempt to resolve any dispute informally. Many issues can be resolved through communication.
16.2 Governing Law
These Terms and Conditions are governed by the laws of the State of Texas, without regard to conflict of law principles.
16.3 Jurisdiction and Venue
Any disputes, claims, or legal actions arising from these Terms or our services shall be resolved in the state or federal courts located in Bell County, Texas. You consent to the personal jurisdiction of these courts.
16.4 Arbitration Option
Alternatively, at our discretion, disputes may be resolved through binding arbitration under the Texas Arbitration Act or the rules of the American Arbitration Association, except for small claims court matters under $10,000.
16.5 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.
17. General Provisions
17.1 Entire Agreement
These Terms and Conditions, together with our Legal Disclaimer, Privacy Policy, and other referenced policies, constitute the entire agreement between you and Crafted Memories Photo Albums LLC regarding our services. These terms supersede all prior agreements, understandings, and communications, whether written or oral.

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. The “Last Updated” date at the top indicates when changes were last made. Your continued use of our services after changes constitutes acceptance of the updated terms.

17.3 Severability
